Return Policy

Pursuant to Section 246a (1) no. 2 of the Introductory Act to the German Civil Code (EGBGB) in conjunction with Section 355 of the German Civil Code (BGB)

You have the right to cancel this contract within fourteen (14) days without giving any reason.

The cancellation period is fourteen days from the day on which:

• you or a third party designated by you – with the exception of the carrier – have taken physical possession of the goods, provided you have ordered one or more goods in a single order and these are delivered together;
• you or a third party designated by you – with the exception of the carrier – have taken physical possession of the last item, provided you have ordered several goods in a single order and these are delivered separately.

To exercise your right of cancellation, you must inform us.

If your decision to withdraw from this contract is made by means of a clear statement (e.g., a letter sent by post or an e-mail), you may use the sample cancellation form included in this document; however, this is not mandatory.

To comply with the cancellation period, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

These General Terms and Conditions (hereinafter “GTC”) govern all contracts concluded between Kianoush Mohammadian (hereinafter “HAPISHI”, “we” or “us”) and the customer (hereinafter “you” or “customer”) via the online shop at https://www.hapishi.shop.

The General Terms and Conditions valid at the time of concluding the contract shall apply. We do not recognise any deviating or supplementary terms and conditions of the customer unless we have expressly agreed to them in writing.

These GTC apply to both consumers within the meaning of § 13 of the German Civil Code (BGB) and entrepreneurs within the meaning of § 14 BGB. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Note: Although this document is provided in English for international customers, according to Section 17.3, the German version of these GTC is legally binding. In the event of any discrepancies, the German text shall prevail.

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal does not apply to contracts for:

• the supply of goods that are liable to deteriorate or expire rapidly (e.g. certain pet food products with a short shelf life);
• the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
• the supply of goods made to the consumer's specifications or clearly personalised.

Important note: Please clearly mark each affected product in its description (e.g. "Excluded from return – opened food packaging"). A general exclusion without labelling at product level is not sufficient under German law.
